This is a statement of the Data Protection Policy adopted by LICENCE CHECK Ltd (‘LICENCECHECK’)
Responsibility for the updating and dissemination of the policy rests with the LICENCECHECK information protection officer. Our policy is subject to regular review to reflect, for example, changes to the legislation in the Data Protect Act. All employees and staff are expected to apply the policy and to seek advice as and when required to do so.
LICENCECHECK needs to collect and use certain types of information about people with whom it deals in order to operate our business. These include current, past and prospective individuals and business clients, LICENCECHECK own employees, suppliers and others with whom LICENCECHECK conducts any business. In addition, LICENCECHECK may occasionally be required by law to collect and use certain types of information to comply with the requirements of government departments. This personal information must be dealt with properly however it is collected, recorded and used – whether on paper, electronically, or other means - and there are safeguards to ensure this in the Data Protection Act 1998 (the ‘Act’).
We regard the lawful and correct treatment of personal information by LICENCECHECK as important to the achievement of our objectives and to the success of our operations, and to maintaining confidence between those with whom we deal and ourselves. We therefore need to ensure that LICENCECHECK, our organisation treats personal information lawfully and correctly.
To this end, we fully endorse and adhere to the Principles of Data Protection, as set out in the Act. The principles our organisation follow regarding any personal information or otherwise shall be processed fairly and lawfully and, in particular, shall not be processed further outside LICENCECHECK for any reason other than for the purpose it was originally intended. It shall be obtained only to be recorded, collected, stored and used as required to verify the driver licence records with our official verification bodies such as the DVLA & DVA NI or any lawful purposes as evidence in law case, the records shall not be further processed in any manner incompatible with that purpose or those purposes. The information collected shall be adequate, relevant and not excessive in relation to the purpose or purposes for which they are processed, shall be accurate and, where necessary, kept up to date, shall not be kept for longer than is necessary for the specified purpose(s), and shall be processed in accordance with the rights of Data Subjects under the Data Protection Act.
This policy was approved by the managing director of the company, the business owner and accountable to the board of directors. All data capture, stored or otherwise should be subject to appropriate technical and organisational measures to prevent the unauthorised or unlawful processing of personal data, or the accidental loss, destruction, or damage to personal data and shall not be transferred to a country or territory outside the European Economic Area unless approved by our data record provider until such measure taken ensure complete protection and security within that country or territory can provide adequate level of protection for the rights and freedoms of Data Subjects in relation to the processing of personal data (if ever applicable). Currently no data is used or transferred outside UK.
Therefore, LICENCECHECK will, through appropriate security management and strict application of criteria and controls:
1. Observe fully with all conditions regarding the fair use and collection of the information.
2. Meet its legal obligations to specify the purposes for which information is used.
3. Only collect and process appropriate information to execute that it is needed to fulfill our operational requirements or to comply with any legal requirement.
4. Ensure that the minimum quantity of information used at any time.
5. Ensure that personal data is correct and kept up to date.
6. Ensure that the information is held for no longer than is necessary currently 6 years please the current year when the data was obtained. This means that data will be destroyed or erased from our system when it is no longer required.
7. Ensure that the rights of all consenting people whom information is held can be fully exercised under the Act (i.e. the right to be informed that processing is being undertaken, to access one’s personal information; to prevent processing in certain circumstances, and to correct, rectify, block or erase information that is regarded as wrong information).
8. Ensure to take appropriate technical and organisational security measures to safeguard personal information at all times ensure that any personal information is not transferred outside the UK without suitable safeguards (if applicable). Currently no data is used or transferred outside UK
To assist LICENCECHECK in achieving compliance, LICENCECHECK has appointed a Security Officer at a senior level within the organisation with specific responsibility for all security matters including full compliance to the Act.
LICENCECHECK have created a dedicated policy to assist the Security Officer to manage, physical or electronic logging on to all data records which records access records by LICENCECHECK staff. Training is provided to all staff on the Act and breaches of security will be reported to our data provider in the event of any breach considered by the company a serious breach in working practices.
