Fleet (Car, Light Goods etc.) and Grey Fleet

Every employer, irrespective of corporate size or vehicle ownership owes a duty of care to their workforce, other road users and members of the public to ensure that anyone driving on company business is properly licensed to drive their vehicle.

The Road Traffic Act 1988 makes it a criminal offence under Section 87(2) for an employer to ‘cause or permit another person to drive on the road a motor vehicle…..otherwise than in accordance with a licence authorising that other person to drive…’ The offence is punishable by a fine.

More far reaching in its effect is the obligation placed on employers by the Health and Safety at Work Act 1974 and associated regulations. This places a general obligation on employers to ensure that reasonable steps are taken to protect the health and safety of employees whilst they are at work. The obligation extends to the provision and/or use of equipment used for work which should be safe and suitable for purpose as well as ensuring that employees are trained in the use of that equipment. A recent substantive increase in the maximum levels of fine that can be imposed by the court means that breaches of the legislation will prove particularly damaging to both the finances and reputation of any offending organisation.

It is firmly established that a vehicle (whether fleet or privately owned) is “equipment” for the purposes of the legislation. It is equally well established that a driving licence check is now the minimum requirement expected to ensure that the driver is suitably qualified.
